Prices in Australian Dollars

1) INSURANCE
It is a condition of the Contract that every passenger must have travel insurance in force for the entire duration of the cruise holiday. Details of suitable insurance, which must as a minimum include medical and repatriation coverage for $2,000,000 must be provided at the time of booking.

2) PRICES
Your holiday is subject to surcharges for increased costs due to changes in the following items: Government action, currency exchange rates, fuel cost, over flying charges and increases in scheduled air fares. Even in this cases we will absorb an amount of equivalent to 2% of the holiday price (excluding amendment charges). Any surcharges will be demanded in writing and must be paid within 14 days from the issue date printed on the surcharge invoice. No surcharges will be demanded in less than 30 days before the commencement of the holiday except in cases of late bookings received within this period. Failure to pay within the requisite period will be treated as a cancellation of the booking by you and cancellation charges shown in the paragraph 8 will apply PROVIDED that the surcharges exceed 10% of the holiday price you will be entitled to cancel your holiday with a full refund of all money paid except for any amendment charges. You must exercise your right to cancel within 14 days from the issue date printed on the surcharge invoice.

3) GROUP BOOKINGS
Prices quoted and cancellation charges are different for group bookings. Details available on request.

4) ALTERATIONS BY THE CUSTOMER
If after booking a cruise holiday, you make itinerary changes involving new air bookings, cruise or land transfers, you will be liable for an amendment charge of $70 on your booking for each amendment. No alteration to the land or air content of your holiday can be made less than 60 days prior to departure. If you wish to transfer to another cruise, this is treated as a cancellation and re-booking and cancellation charges will apply.

5) CANCELLATIONS AND REFUNDS
Cancellation must be made in writing. All tickets which have been issued must be returned together with the notice of cancellation.The following cancellation fees apply based on the date when the company receives written notice of cancellations.

Cancellation refunds will only be made upon return of all air tickets which have been issued. Allow 3 - 4 weeks after this for delivery of refunds. Credit or any deposit or other sums received will be given against the above and any balance refunded. No refunds will be made in the event of interruption or cancellation by the passenger after the start of travel.

6)CANCELLATION BY COMPANY
The company will endeavour to operate holidays as advertised, but reserves the right at any time to cancel cruises and/or other arrangements at any time on or before the date due for payment of balance. The company will not cancel a cruise or other arrangement after the date when payment of the balance of the price becomes due except for reasons of force majeure or other exceptional circumstances which are unforeseeable and beyond the control of the company e.g. by war, strikes, civil disturbances, epidemics, government or judicial orders (seizure of accommodation or means of transport), embargos, natural disasters, ship damage, destruction of places of accommodation, or any other reasons of of force majeure, in the event of cancellation, the company will inform you without delay and will offer cruises and / or other arrangements of at least comparable standard, if available, or a refund of all monies paid.

7)ALTERATIONS BY THE COMPANY
The company reserves the right to later the itineraries, accommodation or any other arrangement at any time, but will not do so within the 14 days before the departure date except for reasons of force majeure or other reasons beyond beyond the control of the company. In the event of material alteration, the company will inform you without delay and will offer you the choice between one of:

(1) A full refund of all money already paid.
(2) An alternative holiday of equivalent, or superior quality, at no extra cost to the passenger.
(3) An alternative holiday lower quality with a refund of the difference in price based on the respective advertised prices.

8) COMPENSATION
If the company cancels a cruise and/or other arrangement for any reasons (other than force majeure, after the date when payment of the balance of the price becomes due, compensation will be payable on the following scale:

12) CHANGES TO ITINERARIES
Itineraries are subject to change and may need to be altered or cancelled specifically because of the river water levels. Peter Deilmann Reederei GMbh & Co.KG reserves the right to abandon any cruise for any cause and to change the itinerary whenever condition, in the opinion of the Master of the Vessel, render it advisable or necessary. Peter Deilmann Reederei GMbh & Co.KG will not be responsible for any loss or expense caused by reason of such changes.

13) CONCILIATION AND ARBITRATION
Any dispute arising out of/or in connection with the contract, which cannot be settled amicably, may be refereed to the Passenger Shipping Association Conciliation and Arbitration Scheme devised by the Institute of Arbitrators. This scheme provides for a simple and inexpensive method of conciliation /arbitration on documents alone with restricted liability of costs for you. The scheme is available only to UK resident where the cruise has been booked in the United Kingdom and does not apply to claims of more than $1,500 per person or $7,500 per booking form or to claims which are solely or mainly in respect of physical injury or illness. Details will be supplied on request.

14) LIABILITY

A)The carriage of passengers and their baggage and the provision of any acclamation or other arrangement made by the company shall be subject to the terms and conditions of relevant airline, shipping company, owner service operator or provider.

B) Subject to the limitations set out below the owner will accept liability within the scope of the legal third-party liability as owner and he will also accept the legal personal liability of the captain and the crew however limited to Euro 76,693 for each single person.

C) The liability of the company is limited in the manner provided by the Athens Convention in 1929 (as amended) or such other international conventions for the time being in force in respect of carriage by air or sea, as though the company were deemed to be a 'carrier' as defined in such conventions

15) AIR FLIGHTS
The company reserves the right to select the carrier and the routing for the holiday. All flights timing and routes will be confirmed with your final travel documents which will be sent about two weeks before the departure. The company cannot be liable for the inability of the carrier to transport the passenger on time to embark the vessel or the passenger is delayed provided that the carrier took all the necessary measures to avoid such delays. Neither the company nor the carrier assumes any responsibility for making connections.The company cannot be held liable to any passenger who is delayed or prevented from joining the vessel at the port of embarkation or for the cost of joining the vessel at any port and/or damages as a result of any inconvenience or loss of enjoyment caused thereby. The company cannot guarantee that the flight will have smoking section.


16) MEDICAL
The company reserves the right to refuse a cruise to anyone, who in the opinion of Peter Deilmann Reederei's medical director or vessel's medical officer, is in such a state of health or physical conditions as to be unfit to travel either on booking, at time of embarkation, or during the cruise.

17) LAW AND JURISDICTION
All contracts incorporating these terms shall be governed by English Law and proceedings shall be brought against the company in the West London County Court of Justice Strand. who shall have exclusive jurisdiction. Any proceedings brought in accordance with the carriers conditions and international conventions.
